In the past decade, numerous ethical frameworks have been developed to support public health decision‐making in challenging areas. Before the COVID‐19 pandemic began, members of the authorship team were involved in research programmes, in which the development of ethical frameworks was planned, to guide (a) the use of new technologies for emerging infectious disease surveillance; and (b) the allocation of scarce supplies of pandemic influenza vaccine. However, as the pandemic evolved, significant practical challenges emerged that led to our questioning the (...) value of these frameworks. We now believe that a normative instrument, such as a framework, cannot adequately or reliably provide the ethical guidance that needs to be incorporated into public health decision‐making during natural disasters or infectious disease emergencies. Recently it has been suggested that there are potentially more dynamic, flexible, and effective ways to navigate decisions involving complex considerations entailed in policies and practices during a public health emergency. In this paper, we first outline the key functions of a public health ethics framework, before describing why we believe it would not be fit for purpose during a crisis. We end by considering whether proposed alternative methods to promote ethical public health decision‐making goals have the potential to meet these objectives. (shrink)

Résumé Cet article soutient que la causalité au sens humien (mettant en relief la succession) qui fut la principale cible des critiques du Réalisme Critique de Bhaskar, demeure très présente dans le concept même de “mécanisme”. En effet, le concept de mécanisme implique une abstraction newtonienne du temps ignorée par le Réalisme Critique. Il s’agit cependant d’un problème plus large d’abstraction mécaniste, que cet article analyse simultanément sous l’angle du Réalisme Critique et de la discipline ayant pour objet l’étude des (...) mécanismes, la cybernétique. Comment des descriptions de mécanismes causals peuvent-elles se réconcilier avec leurs propres abstractions? En réponse nous proposons une dissolution du problème du temps au travers de l’expérience vécue. Par ailleurs, nous traitons également des questions liées à la pédagogie de l’enseignement des abstractions, à la mise au point de nouveaux contextes d’interaction et au rôle des technologies dans la mise en place des contextes ludiques. Enfin, nous dégageons des implications plus profondes pour la recherche réaliste, et soulignons la nécessité de traiter conjointement les problèmes d’abstraction et les problèmes pédagogiques et technologiques. The book falls into four segments. In the first (Chapter 1), the particular conception of deity that has been predominant in western civilization—the theistic idea of God—is explicated and distinguished from several other notions of the divine. The second segment considers the major reasons that have been advanced in support of the belief that the theistic God exists. In chapters 2 through 4 the three major arguments for the existence of God are discussed, arguments which appeal to facts supposedly available (...) to any rational person, whether religious or not. Chapter 5 considers religious and mystical experience as a source and justification for theistic belief. And in Chapter 6 we examine the role that faith may play in the formation and justification of religious belief. We also consider the important issue of whether belief in God may be entirely rational quite apart from any evidence in its behalf. The third segment undertakes an examination of the problem of evil, which some have thought to provide rational grounds for atheism, the belief that the theistic God does not exist. A number of topics quite central to theistic religion are considered in the fourth segment of the book, chapters 8 through 11. These topics include miracles, the question of life after death, problems in relating the idea of divine foreknowledge to the belief in human freedom, and problems arising from the existence of diverse religions. The rapid implementation and continuing expansion of forensic DNA databases around the world has been supported by claims about their effectiveness in criminal investigations and challenged by assertions of the resulting intrusiveness into individual privacy. These two competing perspectives provide the basis for ongoing considerations about the categories of persons who should be subject to non-consensual DNA sampling and profile retention as well as the uses to which such profiles should be put. This paper uses the example of the current (...) arrangements for forensic DNA databasing in England and Wales to discuss the ways in which the legislative and operational basis for police DNA databasing is reliant upon continuous deliberations over these and other matters by a range of key stakeholders. We also assess the effects of the recent innovative use of DNA databasing for “familial searching” in this jurisdiction in order to show how agreed understandings about the appropriate uses of DNA can become unsettled and reformulated even where their investigative effectiveness is uncontested. We conclude by making some observations about the future of what is recognized to be the largest forensic DNA database in the world. (shrink)

The aim of this volume is to introduce students to the philosophy of religion by acquainting them with the writings of some of the thinkers who have made substantial contributions to this area. The text covers many topics that are central to the philosophy of religion, and, for each topic it considers, we have sought to provide a group of readings that reflects various philosophical viewpoints and pursues them in some depth without a loss of clarity.

This dissertation examines the dynamical dark matter problem in twentieth century astrophysics from the point of view of History and Philosophy of Science. The dynamical dark matter problem describes the situation astronomers find themselves in with regard to the dynamics of large scale astrophysical systems such as galaxies and galaxy clusters: The observed motions are incompatible with the visible distribution matter given the accepted law of gravitation. This discrepancy has two classes of possible solutions: either there exists copious amounts of (...) some kind of matter that neither emits nor absorbs radiation , or the law of gravitation must be revised. ;Chapter 2 describes the physical and philosophical foundations of dynamical inferences---inferences from discrepancies between well-founded theoretical expectations and reliable observations to the characteristics of candidate solutions. Chapter 3 discusses the history of dark matter . Chapter 4 reviews the present evidence bearing on the dark matter problem. Chapter 5 evaluates the important candidate matter solutions in light of the available evidence. Chapter 6 evaluates two candidate gravitational solutions on evidential and methodological grounds, and addresses the problem of theory choice. I do not try to solve the dark matter problem, but to uncover and evaluate patterns of inference involved in evidential arguments for and against candidate solutions. ;I show that Newton's "Reasoning from Phenomena" is a good framework from which to understand what is going on in this field. I argue that "higher order" and especially non-dynamical evidence is the best hope for solving this problem in dynamics. This is so in part because of "the dark matter double bind": the very existence of the dark matter problem means that we cannot be sure of the overall matter distribution in astrophysical systems, and this in turn means that the observed motions by themselves cannot provide relative confirmation of any theory of gravitational interactions taking place at these scales. I use Newton's Rules of Reasoning to argue that we should retain General Relativity as our theory of gravity at galactic and greater scales, despite the lack of positive evidence to confirm it over its rivals at these scales. According to a rights forfeiture theory of punishment, liability to punishment hinges upon the notion that criminals forfeit their rights against hard treatment. In this paper, I assume the success of rights forfeiture theory in establishing the permissibility of punishment but aim to develop the view by considering how forfeited rights might be reclaimed. Built into the very notion of proportionate punishment is the idea that forfeited rights can be recovered. The interesting question is whether punishment is the sole means (...) for reclaiming forfeited rights. I argue for a pluralistic theory of rights reclamation, according to which, there are multiple ways by which a wrongdoer can recapture her forfeited rights. In particular, I argue that offering remorseful compensation is a valid means by which a wrongdoer might partially, or fully, reclaim her right against punishment. (shrink)

The connection between the necessary condition and justice is explored in the work of John Rawls, H. L. A. Hart, Karl Marx, Emile Durkheim, Albert Camus and William Shakespeare. The conceptions of justice elaborated in each of these political thinker's works share very little more than the rule of law. Since the conceptions examined (...) are so different and the necessary condition is contained in each, I conclude that there is substantial support for the thesis. ;In order to do justice to the texts examined in this dissertation the plain language, the words on the page, must be given priority but cannot be fully determinative of the text's meaning. The immanent structure of the text, the rules of the text which give it shape and form, must also be discerned. There are no particular rules for interpretation in general, yet each text contains within it its own individual rules. The rules of the text are what allow the meanings of the text to play themselves out for different readers. Understanding the history of the text is also important for interpretation. ;Some interpretations of the theories of justice examined here have sought to change the substance of that theory through interpretation. For example, Marx's theory depends upon the law of equal commodity exchange. As shown in chapter three, if an alien supposition of distributive justice is interpreted into Marx's theory so that the surplus value which Marx claims belongs to the capitalist is redistributed, then the proposed transition to communism, which Marx analyzed and supported, will not occur. Doing justice to Marx's texts allows Marx's theory of justice to come through and be judged on its own terms. Only after that has been accomplished can it be evaluated and compared with other theories. The same association between interpretative method and substantive meaning is demonstrated for each theory. With most states now making sex offender registration information available to the public, journalists must balance their obligation to inform the public about potential dangers with respect for individuals' rights. This article examines the problems journalists face in truth telling and minimizing harm and offers suggestions for covering community notification. At minimum, we suggest journalists verify the accuracy of information received from police, make independent judgments about whether or not publication of sex offender registration information is warranted, and provide background (...) information on the scope and effectiveness of community notification in their areas.
